UNIFORM CONSTRUCTION CODE ADVISEMENT
For builders, PBA legal council recommends that all builders in Pennsylvania should be building to the 2003 International Residential Code (IRC) standard on the 91st day, regardless as to whether their municipality has made a decision to administer and enforce the code or not. There are some exceptions to be noted: If a builder/remodeler has made an application for a building permit PRIOR to the 91st day, that builder/remodeler can still build to the old code. If the builder/remodeler has a signed contract for new building or building renovations prior to the 91st day, they may also still build to the old code.
If the municipality insists that the standard in their community is another code and will not allow the builder to build to the 2003 IRC during this implementation period, the builder should attempt to get that refusal by the municipal building inspector in writing. This preventative measure is to protect the builder from a potential lawsuit from a customer who complains later that their home was not built to the UCC standard during this time period.
